Terms and Conditions of Stay Last updated: October, 2025

Please read these Terms and Conditions carefully before booking your stay at Mesa & Timber(the “Property”). By placing a reservation, you (“Guest”) agree to all terms, rules, and policies outlined below. 1. Booking and Payment Reservations are confirmed only after full payment is successfully processed through our secure online system (Stripe). Instant Booking applies — no prior approval required unless otherwise noted. Accepted Payment Methods: Major credit/debit cards via Stripe. Security Deposit: A pre-authorization hold of $150 USD will be placed upon reservation and automatically released 3 days after checkout, pending property inspection. The hold renews automatically every 7 days for bookings longer than one week. 2. Pricing and Occupancy The base nightly rate includes 2 guests. The maximum occupancy is 2 guests. No unregistered visitors are permitted overnight without prior approval. Children (2–12 years old) are allowed. Infants (under 2) are not recommended due to property safety features (e.g., hot tub, stairs). Violation of occupancy limits may result in immediate termination of stay without refund. 3. House Rules By confirming a reservation, Guests agree to follow all house rules: Use of Hot Tub: The hot tub is used at your own risk. Guests must shower before use, avoid glassware near the tub, and replace the cover when not in use. The Owner is not liable for injuries or accidents resulting from hot tub misuse. Smoking: No smoking is allowed indoors. A $200 cleaning fee will be charged for violations. Parties and Events: No parties or events are permitted unless prior written approval is obtained. Pets: No pets allowed unless explicitly approved in writing. Unapproved pets will incur a $150 cleaning fee. Check-In / Check-Out: Self check-in via smart lock. Check-in: 3:00 PM | Check-out: 11:00 AM Noise: Quiet hours: 10:00 PM – 8:00 AM. Please respect neighbors and nature. 4. Cleaning and Maintenance A cleaning fee of $85 USD applies to each reservation. Please leave the property in reasonable condition (dishes washed, trash collected). Excessive mess or damage may result in additional cleaning charges deducted from the deposit. 5. Damages and Security Deposit Guests are responsible for any loss, damage, or theft occurring during their stay. The pre-authorized $150 deposit hold may be charged, partially or fully, to cover: Property or furniture damage Missing items Excessive cleaning or hot tub misuse Any charges will be communicated via email with supporting documentation. 6. Cancellations and Refunds Standard Policy (Stays under 28 nights): Full refund if cancelled within 48 hours of booking and at least 14 days before check-in. 50% refund if cancelled up to 7 days before check-in. No refund for cancellations made less than 7 days before check-in. Extended Stays (28+ nights): For stays longer than 28 nights, a separate long-term cancellation policy applies and overrides the above. Refunds are issued only to the original payment method used at booking. Processing fees are non-refundable. 7. Chargebacks and Payment Disputes All Guests agree that initiating a chargeback with their bank or card provider for a valid and completed reservation constitutes a breach of contract. Before filing a chargeback, Guest must contact the Host in writing to resolve any issue. If a chargeback is filed for a valid stay or cancellation outside the refund window: Host reserves the right to pursue collection for unpaid balances, including fees incurred due to the dispute. Any proven fraudulent chargebacks will be reported to payment processors and may result in legal action. By booking, you consent to the Host retaining any communication, logs, or security footage necessary to contest a chargeback. 8. Liability and Assumption of Risk Guests acknowledge that the Property includes a hot tub, outdoor areas, and stairs, which may present risks. Guests assume full responsibility for their safety and that of their guests, including children. The Owner and its agents are not liable for injuries, accidents, or loss of personal belongings during the stay. Guests are advised to obtain travel or rental insurance covering cancellations, medical emergencies, and damages. 9. Privacy and Surveillance The Property may use exterior-only security cameras for safety and occupancy verification. There are no cameras inside the property. Tampering with or disabling cameras is a violation of this agreement and may result in termination without refund. 10. Host’s Right to Terminate Stay The Host reserves the right to terminate the reservation without refund if: House rules are violated, Property is used for illegal activity, or Unregistered guests or pets are found on-site. 11. Governing Law These Terms and Conditions are governed by the laws of the State of Ohio, and any disputes shall be resolved in Jackson County, Ohio, or the nearest competent court. 12. Agreement to Terms By submitting payment or confirming your reservation, you acknowledge that you have read, understood, and agreed to all terms, policies, and house rules contained herein.
